Terms of Sale

The contract between you and us when you buy a work: formation, title, authenticity and liability.

01Who you are contracting with

These terms govern every sale made through this site. Placing an order means you accept them. If you do not accept them, do not place the order.

02How a contract is formed

Your order is an offer to buy. A contract is formed when we send the order confirmation, not when the order is placed and not when payment is authorised. Until then we may decline an order — for example if a work has been withdrawn, or if a piece is subject to an export restriction we cannot satisfy.

Prices are shown in the currency stated on the product page and are inclusive of our shipping cost and exclusive of import duties.

03Authenticity

Every work is sold with a signed certificate of authenticity and a provenance dossier recording deity, lineage, pigments, gold weight and the painter of record. The dossier is part of what you are buying.

Our statement of authorship is a statement about who held the brush. It is not a statement about the age of the work: unless the product page says otherwise, every painting we sell is a contemporary work painted in the traditional manner, not an antique.

04Title and risk

Title passes to you when we receive cleared payment in full. Risk passes when you, or someone acting for you, take delivery. Until risk passes, the work is our responsibility and it is insured.

05Limitation of liability

We are responsible for loss you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care. We are not responsible for loss that was not foreseeable, and our total liability for any order is limited to the amount you paid for that order.

Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow parts of this clause to be limited; where that is the case, the rest of these terms still apply.

06Governing law
